Please read these Terms carefully. They govern your use of Riskly, including subscriptions, AI credits, and the entertainment-only nature of the App.
These Terms of Use (the “Terms” or “EULA”) form a binding agreement between you and Focuser LLC (“we”, “us”, “our”) governing your use of the Riskly application (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
This is a license, not a sale. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, subject to the App Store Terms of Service.
Riskly provides statistical estimates for entertainment and educational purposes only. It does NOT provide medical, legal, insurance, financial, or safety advice, health predictions, diagnoses, or real-world guarantees.
Estimates and AI-generated scenarios are produced from generalized data combined with automated reasoning and may be inaccurate, incomplete, or misleading. Never rely on the App to make health, safety, financial, or life decisions. Always consult a qualified professional.
The App does not encourage or endorse participation in any risky activity.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and able to form a binding contract to use the App.
Riskly is offered on an auto-renewing subscription basis. Plans include a weekly subscription and a monthly subscription, each starting with a 3-day free trial for eligible new subscribers.
Payment is charged to your Apple ID account at confirmation of purchase, or at the end of the free trial if you do not cancel beforehand.
Your subscription automatically renews at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
If you begin a free trial and do not cancel before it ends, you will be charged for the plan you selected. Any unused portion of a free trial is forfeited when you purchase a subscription.
You can manage or cancel your subscription at any time in your Apple ID account settings. Deleting the App does not cancel your subscription.
The App includes AI features metered by credits. A base allowance of free credits is provided and refreshes weekly. You may also purchase additional credit packs as one-time in-app purchases.
Purchased credits are added to your balance, do not expire, and remain when your free weekly allowance refreshes. Free weekly credits do not roll over.
AI credits and purchases are non-refundable except where required by law or the App Store’s policies, and have no monetary value outside the App. When you run out of credits, AI features are paused until your free credits refresh or you top up.
All purchases are processed by the Apple App Store. Refund requests are handled by Apple in accordance with its policies. We do not directly process payments or issue refunds.
You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the App except as permitted by law; (b) use the App for any unlawful, harmful, or abusive purpose; (c) interfere with or disrupt the App or its servers; (d) circumvent credit limits, subscriptions, or usage restrictions; or (e) misuse AI features to generate harmful, illegal, or dangerous content.
You are responsible for the information you enter, such as demographics and activities. You represent that you have the right to provide it. Our handling of your information is described in the Privacy Policy.
The App, its content, design, and underlying models and methodology are owned by Focuser LLC and its licensors and are protected by intellectual property laws. Except for the license granted here, no rights are transferred to you.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ESTIMATES ARE ACCURATE OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOCUSER LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP.
Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the 12 months preceding the claim, or USD $50, whichever is greater.
You release Focuser LLC from all liability for any outcome, decision, injury, loss, or damage related to your reliance on estimates, scenarios, or other content in the App.
You agree to indemnify and hold harmless Focuser LLC from any claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the App or violation of these Terms.
We may suspend or terminate your access to the App at any time if you violate these Terms or misuse the App. You may stop using the App at any time. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.
These Terms are between you and Focuser LLC only, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
These Terms are governed by the laws of the State in which Focuser LLC is organized, without regard to conflict-of-laws principles, except where local consumer-protection laws grant you additional rights.
We may update these Terms from time to time. Material changes are reflected by updating the effective date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
